Terms of Service

These Terms of Service ("Terms") govern your access to and use of Catalyst Analytics, a social media analytics and reporting platform operated by Catalyst Communications Pty Ltd ("Catalyst", "we", "us", "our") at app.catalystcommunications.com.au.

By creating an account or using Catalyst Analytics, you agree to be bound by these Terms. If you do not agree, do not use the platform. If you are using the platform on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.

1. About Catalyst Analytics

Catalyst Analytics is a platform that connects to third-party social media APIs (including Meta/Instagram and TikTok) to retrieve analytics data and generate reports on behalf of marketing agencies and their clients. We are an independent service and are not affiliated with, endorsed by, or sponsored by Meta, TikTok, or any other social media platform.

To use Catalyst Analytics, you must create an account by providing accurate and complete information including your organisation name, full name, email address, and password. You are responsible for:

4.1 Your responsibility

When you connect a client's Instagram or TikTok account to Catalyst Analytics, you represent that you have obtained all necessary authorisation from the account owner to do so. You are responsible for ensuring that any social account you connect has granted you the authority to connect it to third-party analytics services.

4.2 Read-only access

Catalyst Analytics accesses social media accounts in read-only mode. We retrieve analytics and profile data only. We do not post content, send messages, follow or unfollow accounts, modify settings, or take any action that alters the state of a connected account.

4.3 Platform compliance

Your use of connected social media data through Catalyst Analytics must comply with the applicable terms and policies of each social media platform, including:

4.4 Revoking access

You can disconnect a social media account at any time from the Catalyst Analytics dashboard. You may also revoke access directly through the social media platform's settings. Upon revocation, we will stop accessing new data for that account, though we may retain historical data in accordance with our Privacy Policy.

5. Intellectual property

5.1 Our platform

All software, design, text, graphics, interfaces, and other content comprising Catalyst Analytics are owned by or licensed to Catalyst Communications Pty Ltd. Nothing in these Terms grants you ownership of or rights to our intellectual property beyond the limited licence to use the platform as described herein.

5.2 Your data

You retain ownership of any data, reports, and content you create or upload through Catalyst Analytics. By using the platform, you grant us a limited, non-exclusive licence to store, process, and display your data solely to provide the service.

5.3 Anonymised data and predictive features

By using Catalyst Analytics, you grant us a non-exclusive, royalty-free, perpetual licence to derive anonymised and aggregated statistical records from social media analytics data processed through the platform, and to use those records to improve and develop platform features including predictive analytics tools.

Anonymisation involves the permanent removal of all identifying information — including account names, handles, URLs, captions, and any other data that could identify a person, account, or organisation — leaving only statistical patterns (such as content type, posting time, engagement rate brackets, and follower count brackets). Anonymised records cannot be re-linked to any individual or account and do not constitute personal information under applicable law.

This licence survives account closure and data deletion requests, as anonymised records are no longer attributable to any individual. You may opt out of contributing data to these anonymised records at any time by contacting us at hi@catalystcommunications.com.au — opting out does not affect your access to the platform or to predictive features.

Uploaded data: Where you upload historical data (for example, in CSV or PDF format) to inform predictive analysis, you represent that you have the right to upload and process that data. Uploaded data is used solely to generate the analysis you have requested and is not stored beyond the duration of that analysis session unless you explicitly save it.

5.4 Feedback

If you provide us with suggestions or feedback about the platform, you grant us a perpetual, royalty-free right to use that feedback without restriction or compensation to you.

6. Subscription, billing, and payment

Access to Catalyst Analytics may require a paid subscription. Subscription details, pricing, and billing terms will be provided at the time of purchase or upgrade. By subscribing:

7. Data and privacy

Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using Catalyst Analytics, you consent to the data practices described in our Privacy Policy.

8. Disclaimers

Catalyst Analytics is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

Social media analytics data is sourced from third-party APIs. We do not guarantee the accuracy of data provided by Meta, TikTok, or any other platform, and we are not responsible for discrepancies caused by changes to those platforms' APIs or data models.

9. Limitation of liability

To the maximum extent permitted by applicable law, Catalyst Communications Pty Ltd and its directors, employees, and contractors will not be liable for:

Our total liability to you for any claim arising from your use of Catalyst Analytics will not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) AUD $100.

You agree to indemnify and hold harmless Catalyst Communications Pty Ltd and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:

Catalyst Analytics integrates with and depends on third-party services. We are not responsible for the availability, accuracy, or conduct of these services. Links to or integrations with third-party platforms do not constitute an endorsement. Your use of third-party services is subject to their own terms and privacy policies.

13. Changes to the platform

We may modify, suspend, or discontinue Catalyst Analytics (or any part of it) at any time with or without notice. We will make reasonable efforts to notify users of significant changes. We are not liable to you or any third party for any modification, suspension, or discontinuation of the service.

14. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will notify you by email or via a notice on the platform at least 14 days before the changes take effect. Your continued use of the platform after the effective date constitutes acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the platform and may close your account.

15. Governing law and disputes

These Terms are governed by the laws of New South Wales, Australia. Any disputes arising from these Terms or your use of Catalyst Analytics will be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.

Before initiating legal proceedings, we encourage you to contact us at hi@catalystcommunications.com.au to resolve the dispute informally. We will make reasonable efforts to resolve disputes within 30 days of notification.
